T&C for Property Owners – mediumterm.ch
1. Introduction
These Terms and Conditions govern your use of the mediumterm.ch platform, operated by Swissconsulting Residential Sagl, Via Clemente Maraini 5, 6900 Lugano, Switzerland, under Swiss law. By creating an account, accessing, or listing a property on the Platform, you (“you” or “Host” or “Owner”) agree to be legally bound by these Terms.
mediumterm.ch is a neutral listing and communications platform designed to facilitate medium-term rental connections between Hosts and prospective tenants (“Users”). We do not function as a real estate broker, agent, or rental manager. We do not assume responsibility for any part of the rental transaction, unless explicitly stated.
2. Eligibility
To list a property on the Platform, you must:
- Be at least 18 years old and have full legal capacity;
- Be the legal owner of the property or possess written authorization to rent it on behalf of the legal owner;
- Ensure that no legal claims, encumbrances, or disputes exist that would prevent you from renting the property.
- You represent and warrant that you are acting in compliance with all applicable federal, cantonal, and municipal housing laws and regulation
3. Property Listings
You are fully responsible for the content and accuracy of your listings, including but not limited to:
- Property descriptions, rental conditions, amenities, pricing, and availability;
- Whether utilities (electricity, water, heating), internet, cleaning services, and taxes are included in the rent;
- Uploading accurate and unaltered photographs;
- Ensuring that any images used are owned by you or properly licensed.
mediumterm.ch reserves the right to edit, reject, suspend, or remove any listing at its sole discretion if it:
- Is incomplete, misleading, fraudulent, or violates Swiss laws or community guidelines;
- Is suspected to be a duplicate or involves unethical or discriminatory language.
4. Host Responsibilities
By using the Platform, you agree to:
- Offer a clean, safe, and habitable property in accordance with all relevant health, fire, and building codes;
- Provide and maintain all listed amenities;
- Respect the privacy and legal rights of your tenants;
- Respond to tenant inquiries and booking requests in a timely and professional manner.
You are solely responsible for handling tenant communication, contract signing, check-in/check-out logistics, and conflict resolution.
mediumterm.ch is not a party to any rental contract and assumes no liability for the fulfillment, enforcement, or termination of any lease.
Any verbal or written agreement made between you and a tenant is at your own risk.
5. Tenant Screening
We may, at our discretion, provide optional identity verification services.
- These checks may include basic ID verification, proof of employment, or background searches.
- However, mediumterm.ch does not guarantee the accuracy, completeness, or reliability of such verifications.
- The decision to accept a tenant rests solely with you, and you do so at your own discretion and risk.
6. Payment Terms
- mediumterm.ch does not collect, hold, or transfer rental income between parties unless explicitly stated or mutually agreed upon.
- Listing and promotional fees are clearly communicated before publication.
- Payment for any optional service (e.g., photography, verification, 3D tours) is required in advance.
Failure to pay applicable fees may result in immediate suspension or termination of your account and listings.
mediumterm.ch is not liable for late, partial, or missing rent payments between parties.
7. Cancellations & Refunds
- You may define your own cancellation and refund policy (e.g., flexible, moderate, strict) per listing.
- If you cancel a confirmed booking without justifiable cause (e.g., force majeure), penalties may apply, including deactivation of listings.
8. Damage and Security Deposits
- You may request a damage deposit and must clearly disclose the amount and terms in your listing.
- All damage disputes must be documented with dated photo evidence and submitted within 48 hours of tenant departure.
9. Platform Liability and Disclaimers
- mediumterm.ch acts solely as an intermediary between Hosts and tenants.
We:
- Do not offer legal, financial, or tax advice;
- Do not provide guarantees regarding tenant behavior, property conditions, or successful bookings;
- Are not responsible for enforcing house rules, rental agreements, or local tenancy laws.
- You agree to indemnify and hold harmless Swissconsulting Residential Sagl, its officers, affiliates, agents, and employees from any claims, damages, losses, or disputes arising from your use of the Platform or any transactions initiated through it.
- We disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
10. Blue Badge Verification Program
The “Blue Badge” symbol indicates that a property has undergone physical inspection and document verification.
- A representative of mediumterm.ch has visited the property to verify that it matches its listing photos and key documents were presented.
- We do not guarantee the continuous accuracy of the property condition after verification, nor do we conduct repeated or ongoing checks.
- Verification does not include tenant vetting, landlord identity checks, or legal title confirmation.
Any issues that arise after the verification date are beyond the scope of our responsibility.
11. Insurance
You are solely responsible for securing appropriate property and liability insurance.
mediumterm.ch does not provide insurance coverage of any kind and is not liable for damages, accidents, injuries, or theft that occur during the rental period.
12. Third-Party Services
The Platform may offer optional paid services (e.g., relocation assistance, professional photography) that are fulfilled by external contractors.
- You acknowledge that these third parties operate independently, and any claims related to service quality, pricing, or delivery must be directed to them.
- mediumterm.ch is not responsible for delays, errors, or disputes arising from third-party services, even when contracted through us.
13. User Conduct and Misuse
You agree not to:
- Use the Platform to post illegal, defamatory, discriminatory, or offensive content;
- Circumvent the Platform by encouraging tenants to book off-platform to avoid fees;
- Reproduce, scrape, or commercially exploit any Platform data or content without written permission.
Violation of these terms may result in immediate account termination and legal action.
14. Termination
You may deactivate your account at any time, provided no bookings are pending or active.
mediumterm.ch reserves the right to suspend or permanently terminate any account that:
- Violates these Terms or applicable laws;
- Is associated with fraudulent or harmful activity;
- Receives repeated complaints from Users or third parties
15. Data Protection & Privacy
All user data is processed in accordance with the Swiss Federal Data Protection Act (nLPD) and, where applicable, the EU General Data Protection Regulation (GDPR).
- You agree to use tenant data solely for the purposes of managing inquiries or rental agreements.
- Misuse or unauthorized sharing of user data may lead to legal consequences.
16. Governing Law and Dispute Resolution
These Terms shall be governed and interpreted under the laws of Switzerland.
Any legal disputes shall be subject to the exclusive jurisdiction of the courts in Lugano, Switzerland.
17. Changes to Terms
mediumterm.ch reserves the right to amend these Terms at any time.
Continued use of the Platform following any changes constitutes your acceptance of the revised Terms.
